Terms of use

Effective date: 1 march 2023

This User Agreement (hereinafter referred to as the Agreement) governs the relationship between (hereinafter Node.sys or the Administration) on the one hand and the user of the site on the other.

The Node.sys site is not a mass media site.

By using the site, you agree to the terms of this agreement.

If you do not agree to the terms of this agreement, please leave the site immediately.

By accepting the Agreement, you also agree to our Privacy Policy.

General provisions of the User Agreement

In this document and the resulting or related relations between the Parties, the following terms and definitions apply:

a) User — a capable natural person who has acceded to this Agreement in his own interest or acting on behalf and in the interests of the legal entity they represent. 

b) Administration Site / Site — Internet sites hosted in the nodesys.io domain and its subdomains.

c) Service - a set of services provided to the User using the Site.

d) Agreement - this agreement with all additions and changes.

Modification of this Agreement

The Agreement (including any of its parts) may be changed by the Administration without any special notice. The new version of the Agreement comes into force from the moment it is posted on the Site or brought to the attention of the User in another convenient form, unless otherwise provided by the new version of the Agreement.

Spread of information

The information provided on the Site is not intended for distribution to or use by any person or entity in any jurisdiction or country where such distribution or use would be contrary to law or regulation. Accordingly, persons who choose to access the Site from other locations do so on their own initiative and are solely responsible for compliance with local laws.

Site user age criteria

The site is intended for users over the age of 18. You agree that when using the Site and the Service, you are at least 18 years of age, or you are accessing the Service under the supervision of a parent or guardian, and you are legally able to enter into a contract. If you are the parent or legal guardian of a user under the age of 18 (or the age of majority), you agree to be solely responsible for such user's actions or omissions in relation to the Service. 

Electronic communications

We secure the information you provide on computer servers in a controlled, secure environment that is protected from unauthorized access, use, or disclosure. We take reasonable administrative, technical and physical security measures to protect against unauthorized access, use, modification and disclosure of personal data under its control and storage. However, data transmission via the Internet or wireless network cannot be guaranteed. 

You may visit the Site without telling us who you are and without disclosing any information by which anyone could identify you as a specific individual. However, if you would like to use certain features of the site, or would like to receive our newsletter or other information, by completing the form, you can provide us with your email address. You may choose not to provide us with this information, but if you do so, you may not be able to use certain features of the Site. For example, you will not be able to receive our newsletter or contact us directly through the Site. Users who are not sure what information is required can contact us via info@nodesys.io. 

Copyright and licenses 

You agree not to use the Site as an object of intellectual property rights in any way not permitted by this Agreement, in particular, it is prohibited to:

You have the right to use the site information for personal non-commercial purposes.

Procedure for reporting copyright or intellectual property infringement

We respect the intellectual property of others.

Disclaimer of Warranties / Limitation of Liability

The information provided on the site is for informational purposes only and should not be construed as any form of investment or legal advice.

Node.sys makes no warranty, express or implied, with respect to the information provided on the site and/or your use of the Node.sys site in general or for any particular purpose. Node.sys expressly disclaims any implied warranties, including, but not limited to, warranties of title, non-infringement, merchantability, or fitness for a particular purpose.

Nodesys.io hereby expressly excludes any liability for any direct, indirect loss or damage suffered by any user in connection with the site or in connection with the use, inability to use or results of using the site, any sites linked to it, and any materials posted on website, including lost profits or contracts; loss of expected savings, income or revenue; data loss or business reputation.

Links to other sites

Our Site may contain links to other sites that are not owned or controlled by us. Please note that we are not responsible for the privacy practices of such sites or third parties. We encourage you to check when you leave our Site and read the privacy statements of each site that may collect personal information.

Dispute Resolution

In the event of any disputes or disagreements related to the execution of this Agreement, the User and the Administration will make every effort to resolve them through negotiations between them. In the event that disputes are not resolved through negotiations, disputes shall be resolved in the manner prescribed by international law.

The claim procedure for pre-trial settlement of disputes from the Agreement is mandatory.

Compensation

The User is responsible for all expenses (including compensation for losses, harm, fines, legal and other costs and expenses) of the Administration in case of any claims by third parties, including (but not exclusively) claims related to the protection of intellectual rights of third parties , and for any obligations incurred by Node.sys in connection with the requirements of third parties related to the violation by the User of the terms of the Agreement. The User undertakes to take all necessary and possible measures aimed at exclusion of Node.sys from the number of defendants in such claims.

Node.sys is not liable to the User and does not reimburse the User for any losses incurred or that may arise from the User due to delays, interruptions in the operation of the Site, the impossibility of full use of the Site.

Other provisions

Node.sys and members reserve the right to investigate complaints or reports of violations of this Agreement and take any action they deem appropriate, including, but not limited to, reporting any suspected illegal activity to law enforcement officials, regulators, or other third parties and disclosing any information necessary or relevant to such persons or entities regarding user profiles, email addresses, usage history, hosted content, IP addresses and traffic information.

We reserve the right to pursue all remedies available at law and in equity for a breach of this Agreement, including, but not limited to, the right to block access from a specific internet address to the site.

Node.sys' failure to enforce or enforce strict performance of any provision of this Agreement shall not be construed as a waiver of any provision or right. Neither the course of conduct between the parties nor trade practice shall alter any provision of this Agreement.

Node.sys may assign its rights and obligations under this Agreement to any party at any time without notice. If any of these terms is held to be invalid or for any reason unenforceable, that term will be deemed severable and will not affect the validity or enforceability of any remaining term. Any rights not expressly granted here are reserved.
